The managerial employee was entrusted with expensive tangible assets. However, during the official inspection the company found out that the said employee wrote the assets off under fake documents and illegally transferred some assets to the third party. Such behavior discredited the employee in the company’s eyes and caused his dismissal.
During the trial, ABY’s lawyers managed to prove both the existence of legal and factual grounds for dismissal under the article and the company’s compliance with the employee termination procedures.
On October 15, 2019, the Prikubansky District Court dismissed the employee’s claims on illegal disciplinary responsibility and employment reinstatement.
