Advocates Bureau Yug Successfully Achieves Cancellation of Judicial Decisions Regarding Relocation of Power Line and Support Tower

Advocates Bureau Yug acted as legal counsel for a prominent grid company in a legal matter concerning the mandatory relocation of overhead and high-voltage power lines, along with their supporting towers, from a third-partys land parcel. A prior court order mandated the Client to execute this relocation.

The enforcement officer lodged a formal motion to terminate the enforcement proceedings due to impracticability, which stemmed from the Clients inability to relocate the electrical grid facilities as it contravened urban planning regulations and regulations governing the operation of electrical installations. Moreover, It was impossible to establish new land plots for the placement of the support towers in accordance with land management and urban planning regulations.

The courts previously rejected the termination motion filed by the enforcement officer.

During this appeal, Advocates Bureau Yug meticulously argued the presence of exceptional circumstances within the case materials that demonstrably impeded the Clients ability to comply with the initial court decision. ABYs legal team demonstrated that the designated relocation route traversed a densely populated area with a residential sector and a complex network of existing subterranean and above-ground utilities. Any attempt to reconstruct the overhead line in this location would inevitably lead to violating relevant regulatory statutes.

Finally, the Fourth Cassation Court of General Jurisdiction issued a ruling on January 19, 2024, which overturned the previous appellate court decision and remanded the case for a fresh appellate review.

Given the prevalence of similar legal disputes, the establishment of favorable case law on this matter holds significant economic importance for the Client.
