The enforcement officer lodged a formal motion to terminate the enforcement proceedings due to impracticability, which stemmed from the Clients inability to relocate the electrical grid facilities as it contravened urban planning regulations and regulations governing the operation of electrical installations. Moreover, It was impossible to establish new land plots for the placement of the support towers in accordance with land management and urban planning regulations.

The courts previously rejected the termination motion filed by the enforcement officer.

During this appeal, Advocates Bureau Yug meticulously argued the presence of exceptional circumstances within the case materials that demonstrably impeded the Clients ability to comply with the initial court decision. Finally, the Fourth Cassation Court of General Jurisdiction issued a ruling on January 19, 2024, which overturned the previous appellate court decision and remanded the case for a fresh appellate review.
